1.3.- The person who contracts through the WEBSITE (hereinafter, the “USER”) will be bound by the provisions of these CONDITIONS, so you must not contract if you do not agree with any of its terms. 2.- IDENTIFICATION OF THE SERVICE PROVIDER

3.- DESCRIPTION OF THE SERVICES OFFERED

3.1.- The services offered by SOLTECSIS consist of:

  • Online courses in the areas of specialisation of SOLTECSIS
  • Other services that, where appropriate, may be described on the WEBSITE below

3.2.- The training services will be provided online, through teletraining platform and testing laboratory. The courses will be developed according to the operation and the program described in each case on the WEBSITE.

3.3.- The WEBSITE will show a description of each course offered, including the duration of the course, the scheduled dates for its completion, the number of attendees recommended, the program of sessions that includes, the activities to be carried out during the same and the communication channels to be maintained with the USER.

4.- RECRUITMENT PROCESS

4.1.- To make the online contracting of the services offered through the WEBSITE, the USER must access the section where the course to which they want to access is specified.

4.2.- Once the USER has known all the details of the service of his interest, to contract must click on the drop-down and choose an option from among those offered (dates) include the number of students who will attend the training and then click on the button “Add to Cart” in this way, the selected service will be directly added to the “Carrito”, when the USER can check the units of each service chosen and their price, to which in each case the corresponding taxes must be added. 4.7.- In the contracting process, the USER will be required to expressly accept these CONDITIONS, by marking the corresponding box.

4.8.- SOLTECSIS will issue the invoice corresponding to the contracted service that will reach you directly to your email, being able to request it by the USER through the email address info@soltecsis.com, if in a reasonable period you have not received it.

4.9.- The electronic documents in which the orders are formalised will be archived by SOLTECSIS, the USER may access them by request through the email address info@soltecsis.com.

4.10.- The contracting of the services through this WEBSITE will be formalised only in Spanish. If discrepancies arise from any machine translation, it will be the Spanish text that determines the contracting conditions

5.- PRICE AND PAYMENT

5.1.- The prices applicable to the contracting of services are those indicated on the WEBSITE at the time of making the reservation, to which must be added the VAT (Value Added Tax) when it is applicable in accordance with the provisions of the current regulations governing said tax.

5.2.- SOLTECSIS reserves the right to modify the prices of the services, but any changes will not affect the reservations in respect of which a CONFIRMATION OF ORDER has been sent.

5.3.- The USER will make the payment of the services by credit card among those indicated, through the Stripe payment platform or through PayPal. This platform uses encryption technology for payment information transmitted through the WEBSITE. In the event that the payment transaction is rejected by the payment platform provider, the procurement shall be deemed not to be carried out.

5.4.- To enter the data of a credit card the USER must be its legitimate holder and have the right to use it. The USER has the responsibility that all the data provided in order to pay for the contracted services are correct.

5.6.- The WEBSITE has an SSL security certificate, guaranteeing the secure transmission of information through its encryption.

6.- EXECUTION OF SERVICES

6.1.- When you hire our training courses, these will be provided online, live and through the BigBlueButton teleforming platform, which will only require access per student on any computer, tablet or smartphone with camera, audio and Internet connection that has a browser, without the need to install any program.

6.2.- It will be sought to establish communication with the user through the sending of an email in which the access link will be provided as well as their login and password access to the platform. Both SOLTECSIS and the user will be responsible for taking the necessary measures to ensure that online sessions are held in conditions that allow the confidentiality of communications.

6.3.- It is expressly prohibited the recording, reproduction or publication by any means of the training sessions developed in execution of the contracted services, except with the prior express written consent of SOLTECSIS and the user.

6.4.- For the provision of the service it will be necessary to assign the user a password for access to the contents of the course. In such cases, the assigned password will be unique and for the exclusive use of the user, so its communication to third parties is not allowed. It will be the responsibility of the USER to preserve the confidentiality of the assigned password and its diligent custody.

7.- CANCELLATION POLICY/MODIFICATION OF ORDERS

7.1.- The USER who has contracted any of the services offered on the WEBSITE may request its cancellation or the modification of the dates/times initially scheduled, provided that he requests it to SOLTECSIS through the email info@soltecsis.com or another that is specifically designated at least seven days in advance with respect to the time at which the execution of the service affected by the request was scheduled.

7.2.- Once the previous communication has been received, SOLTECSIS will contact the USER in order to confirm his request for cancellation or to arrange a new date/time for its execution.

7.3.- If the USER confirms his wish to cancel the service, after having communicated his request within the period indicated in paragraph 1 above, SOLTECSIS will refund the payment previously received without undue delay, using the same means of payment used by the USER for the initial transaction.

8.- CLAIMS MANAGEMENT

The USER can send to SOLTECSIS any incident, complaint or claim in relation to the contracting of services through the email info@soltecsis.com. SOLTECSIS will contact the USER as soon as possible in order to respond to such complaints or claims.

9.- PROTECTION OF PERSONAL DATA

SOLTECSIS, as controller, will process the data provided by the USER during the process of electronic contracting of services in order to carry out the administrative and economic management of said contracting, including billing, collection and operations related to its execution.

The legitimacy for the processing of the personal data of the USER is based on the execution of the contractual provision entrusted, as well as compliance with legal obligations applicable to the controller in tax matters. The communication of the USER’s personal data is a necessary requirement to formalise the contract made, as well as to comply with the aforementioned legal obligations.

The personal data provided by the USER will not be communicated to third parties, except in case of legal obligation such as, for example, the communication to the Tax Administration of data derived from the billing of the contracted services.

On the other hand, the following service providers contracted by SOLTECSIS may access the personal data of the USER, exclusively for the adequate provision of the aforementioned services: our tax advice, website hosting provider, platform provider used to conduct training with USERS, email provider and secure payment service providers.

The use of some of these tools for the execution of the services may lead to the international transfer of the personal data of the USER to the respective providers of the same located in the United States. As reported in the privacy policy, these providers have adopted the standard contractual clauses of data protection approved by the European Commission, so that the aforementioned international data transfer is carried out in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679).

The personal data of the USER will be kept for the duration of their contractual relationship with SOLTECSIS and, subsequently, during the applicable legal periods and the time necessary to determine the possible responsibilities that may arise from said purpose and from the processing of the data.

In the cases and under the conditions provided for in the current legislation on the protection of personal data, the USER may exercise in relation to his/her personal data the rights of access, rectification, deletion, opposition, limitation of processing, data portability, opposition to automated individual decisions and revocation of consent, by request addressed to the email address info@soltecsis.com, identifying appropriately.

Similarly, the USER will have the right to file a complaint with the Spanish Data Protection Agency, especially when he has not obtained satisfaction in the exercise of his rights, by writing to the following postal address: C/Jorge Juan, 6, 28001 — Madrid, or through its electronic headquarters (www.aepd.es).

10.- GUARANTEES AND EXCLUSION OF RESPONSIBILITIES

10.1- SOLTECSIS will observe the professional due diligence in the provision of the services offered, ensuring at all times the interests of the USERS.

10.2.- The USER acknowledges and accepts that the contracting of services through the WEBSITE will be carried out under his sole responsibility. Similarly, it will be the sole responsibility of the USER to follow up on the recommendations, application of training contents and other elements derived from the execution of SOLTECSIS services.

10.3.- SOLTECSIS is not responsible for the lack of availability, technical incidents or operating errors that may occur in the use of the Internet, telecommunications networks and the tools and platforms used for communication with the USER.

10.4.- SOLTECSIS is not responsible for non-compliances, impediments or delays in fulfilling an order attributable to events beyond its reasonable control (hereinafter, “force majeure causes”), including without limitation any natural disasters, social shocks, wars, national emergencies, terrorism, piracy, strikes, lockouts, epidemics/pandemics, accidents, non-existence or problems with the supply of public services (including incidents with the supply of electricity, telecommunications or internet), shortage or absence of supplies, materials, equipment or transport, etc.

11.- PARTIAL NULLITY

If any of the terms of these CONDITIONS are declared null and void by a final decision issued by the competent authority, the remainder of the terms shall remain valid and shall remain in force.

12.- APPLICABLE LEGISLATION AND JURISDICTION

12.1.- The relationship between SOLTECSIS and the USER derived from the contracting of services through the WEBSITE will be governed by Spanish legislation.

12.2.- SOLTECSIS and the USER submit, for the resolution of any conflict or controversy and waiving any other jurisdiction, to the Courts and Tribunals of the city of Alicante.
